How Long Is the Divorce Process in Ontario?
The length of a divorce proceeding depends on the type of divorce you’re getting and the various stipulations involved. Remember, every divorce case is unique. Uncontested divorce cases typically move forward quickly because both parties agree to all of the terms and conditions of the contract. All they need is the permission of the court to finalize the divorce.
A contested divorce, on the other hand, is much more complicated and can take years to settle depending on the circumstances. A divorce is classified as contested when both parties are in disagreement over a number of factors including child support, child custody, whether or not they both even want to get divorced, the division of assets, or other terms of the divorce.
There are also three legal grounds for divorce in Ontario that must be adhered to:
- The couple must be separated for at least one year with absolutely no chance of reconciliation
- One or both of the spouses committed adultery
- One or both of the spouses has exhibited physically and mentally abusive behaviour to the extent that continuing to live together would be inhumane and unbearable
